A legislative initiative modified the rules concerning terms of payment in the transport sector. The law "Transport Security and Development" no. 2006-10, January 5, 2006 published in the Official journal January 6, 2006 modifies the article L441-6 of the Code of Commerce as follows (see schedule):
“Contrary to conditions of previous paragraph, concerning road transport of goods, rental of vehicles with or without driver, transport commission agents as well as for activities concerning freight forwarders, shipping and air freight agents, freight brokers and customs agents, agreed terms of payment can in no way exceed 30 days from the date of issue of the invoice.”
In case of failure to comply with this legal clause, we draw your attention to the fact that the penal responsibility of the moral person may be involved according to article 121-2 of penal code together with a fine of 15 000 Euros.
